The Development Appeal Board (DAB) provides residents with a way to appeal decisions made by Council and a Development Officer.
If you disagree with a development decision that affects you, the Board offers an independent and impartial review through a formal hearing process.
What does the board do?
The Board:
- Reviews appeals of Development Officer decisions
- Holds hearings where all parties can present information
- Makes decisions based on planning rules and applicable legislation
- The Board operates under the Community Planning and Development Act
- Once the Board makes a decision, it is final and binding. There is no further appeal
Who sits on the board?
Members are appointed by Yellowknife City Council and include:
- A Chairperson
- One member of City Council
- At least two members of the public
The Board currently has seven members.
The City Clerk serves as Secretary to the Board and helps coordinate hearings and documentation.
The Board has 60 days from the date the appeal hearing concludes in which to render its decision in writing. The decision of the Board is final and binding on all parties and is not subject to further appeal.
The Appeal Hearing must commence within 30 days after the notice of appeal is received and shall be completed as soon as is reasonably practicable
